Mother alleges doctor error lead to lifelong injury of son

Of all medical malpractice claims, birth injuries may be some of the most tragic. Many people can find a way to overcome the illnesses and injuries that they suffer themselves, but it can be much more difficult to bear when these things happen to a child. There are many causes of birth injuries in Maryland, including doctor error.

A mother alleged that a doctor’s mistake is the very thing that lead to her newborn son suffering an injury that may plague him for the rest of his life. The woman asserts that it was her doctor’s rough handling of the baby during delivery that caused the boy’s arm to suffer permanent nerve damage. She claims that medical experts used “inappropriate techniques” when he pulled on the newborn’s arms.

The mother also alleges that the doctor compounded this problem when he failed to diagnose the shoulder injury that the boy suffered. She alleges all of this occurred due to the fact that the doctor had been drinking at a local happy hour before being called in to deliver her child. The doctor has been accused of medical malpractice before — he once settled a lawsuit due to a negligent birth in which a similar shoulder injury occurred.

A medical professional, including the health care facility where he or she is employed, may face liability claims for medical malpractice due to improper treatment, doctor error or even treating a patient without receiving proper permission. Successfully navigated, a lawsuit may result in an award of financial relief that may help with the cost of medical bills and other monetary damages recognized by applicable laws. An experienced Maryland attorney can help assess a potential claim and provide ongoing support and guidance in validating the claim in court.
