The dangers of texting while driving have become common knowledge over the last few years. As a result, most states have enacted some sort of law to limit this form of distracted driving. The hope is that such action will reduce the number of car and motorcycle accidents. One young Anne Arundel woman, who was involved in a fatal car accident, will now be prosecuted under a new law that bans texting while driving.
The accident occurred in March 2013. Authorities claim the 19-year-old driver pulled into the path of a motorcycle driven by a 30-year-old man. The man died as a result of the accident.
Prosecutors say evidence from eyewitnesses and phone records prove the woman was texting at the time of the accident. She has since been charged with manslaughter as a result of the collision. New laws in Maryland, which ban texting and talking on a handheld phone, became effective just days before the woman was charged.
The man killed in the collision was a father and motorcycle enthusiast. As a result of his death, his family is likely wondering how they will support his young children without him. Many victims of motorcycle accidents, or their families in the case of fatalities, choose to seek financial reimbursement in a civil court. If this man’s family is able to prove that his death was caused by the Anne Arundel woman’s negligence, they could receive monetary damages to help alleviate the financial burdens they are likely experiencing due to the death of their loved one.
