In Maryland and elsewhere, countless numbers of people trust doctors with their health and lives. That is a reasonable assumption, as physicians and other health care professionals have a sworn duty to provide safe, ethical and accurate medical treatment for their patients. An out-of-state medical malpractice lawsuit was recently filed against a doctor and Lincoln Surgical Associates. The victim alleges that medical malpractice occurred when he underwent a medial gastrocnemius flap procedure. It is claimed that denervation of the flap never occurred, and the physician did not provide the appropriate post-surgery care.
As a result, the man claims that he suffered permanent, severe and disabling injuries. These injuries resulted in him suffering great pain, loss of his enjoyment of life, as well as mental anguish. Additionally, he required several additional surgeries, each costing a significant sum of money. The victim is seeking a monetary judgment against each of the defendants for over $50,000, plus applicable costs of his suit.
Medical malpractice occurs when a medical professional fails to meet the accepted standards of care in his or her area of medicine. A claim has two main components — the malpractice was occurred due to the negligence of a medical professional or hospital (or similar health care provider), and the act directly resulted in the injury or death of the victim.
